Digital signatures created via RentSign are valid and enforceable under the Information Technology Act, 2000 and the Indian Evidence Act, 1872. OTP-based authentication satisfies the identity verification requirements for electronic contracts in India.
Legal Validity
Is a digitally signed rental agreement valid in India?
Yes. Under Section 10A of the Information Technology Act, 2000, contracts formed electronically are legally valid. A rental agreement signed via RentSign — with OTP-based identity verification and a tamper-proof audit trail — is enforceable in Indian courts.
Can this be used in court as evidence?
Yes. Under Section 65B of the Indian Evidence Act, electronic records are admissible as evidence. The audit trail (timestamps, IP addresses, OTP verification records) stored by RentSign strengthens your legal position significantly.
Is stamp duty required for a digitally signed agreement?
Stamp duty rules vary by state. For 11-month rental agreements in most states, stamp duty is not mandatory — which is why the 11-month format is standard across India. For agreements over 12 months, stamp duty typically applies. RentSign is designed for 11-month agreements. Consult a local lawyer for your specific situation.
Can this be used for property sale deeds or long-term leases?
No. RentSign is built specifically for short-term rental agreements (up to 12 months). Property sale deeds and long-term leases require registration with the Sub-Registrar's office and physical execution — they cannot be done digitally via this platform.
What if the tenant disputes the agreement later?
The OTP verification creates a strong link between the signer's registered mobile number and the agreement. The audit trail records the time, IP address, and device used. Together, these make it very difficult to credibly dispute a signature made through RentSign.
Security & Privacy
Can someone fake a signature?
No. Each signature requires an OTP delivered to the signer's registered mobile number. Without access to that physical phone, no one can complete the signing. This is comparable to — and often stronger than — a handwritten signature.
How is the document protected after signing?
Once all parties sign, the PDF is sealed with a cryptographic hash. Any alteration to the document after signing will change the hash and be detectable. The original sealed PDF is stored securely on our servers.
Is my personal data safe with RentSign?
Your documents and personal details are stored on secure servers. We do not sell or share your data with third parties. OTP verification is done via your mobile network — we never store your OTP. See our Privacy Policy for full details.
What happens to my documents if I stop using RentSign?
You can download all your signed PDFs at any time from your dashboard. We recommend downloading and keeping a copy for your records. We retain documents for a minimum of 3 years after signing.
Using RentSign
Does the tenant need to create a RentSign account?
No. The tenant receives a unique signing link via SMS and email. They click it, review the agreement, receive an OTP on their phone, and sign — all without creating an account or downloading anything.
What if the tenant doesn't have a smartphone?
The signing page works on any phone with a browser — even basic Android phones. It also works on any computer. An SMS with the link is sent to their mobile number, and they can open it from any device.
Can I use my own rental agreement format?
Yes. Upload your agreement as a PDF and RentSign will handle the signing process. Alternatively, use our pre-built rental agreement template which covers all standard 11-month rental terms.
How long does the signing process take?
Under 3 minutes per signer — typically. You send the link, they open it, read the agreement, tap "Send OTP", enter the 6-digit code, and done. Total elapsed time depends only on how quickly each party acts.
What happens if the OTP doesn't arrive?
The signer can click "Resend OTP" after 30 seconds. OTPs are also sent to their email as a backup. If issues persist, check that the mobile number entered is correct and has network coverage.
Can I have more than one tenant sign?
Currently RentSign supports one landlord and one tenant per agreement — the standard format for most Indian rental agreements. Support for multiple signers (e.g. co-tenants) is on our roadmap.
